Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, dashboards, hosting, domain registration, AI assistant, and related services (collectively, the "Services") provided by NetWise Hosting LLC ("NetWise", "we", "us"). By creating an account or using the Services you agree to be bound by these Terms. If you don't agree, don't use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at security@netwiseaibiz.com if you suspect unauthorized access.

2. Acceptable use

You may not use the Services to:

• Send spam, phishing, or unsolicited bulk messages.
• Host or distribute malware, illegal content, or material that infringes intellectual property rights.
• Train the AI assistant to impersonate a real person without consent, or to provide medical, legal, or financial advice as if licensed.
• Attempt to probe, scan, or breach the security of our infrastructure.
• Resell raw hosting capacity outside the Agency plan terms.

We may suspend or terminate accounts that violate these rules without refund.

3. AI services

The AI assistant generates responses using third-party large language models (currently OpenAI). Output may be inaccurate, incomplete, or out of date. You are solely responsible for reviewing the AI's training data and for any content shown to your customers. NetWise makes no warranty that AI output will be fit for any particular purpose.

4. Billing & refunds

Subscription plans renew automatically on the same calendar day each month or year until cancelled. New accounts are eligible for a 14-day money-back guarantee on their first plan; after that window, cancellations stop future renewals but no partial refunds are issued. Domain registrations, premium SSL certificates, and one-time services (copywriting, migration) are non-refundable.

5. Domain registrations

Domains are registered through accredited registrar partners under the registrant's name. You agree to the ICANN Registrant Rights & Responsibilities and the registrar agreement applicable to each TLD. Renewals occur 30 days before expiry; failure to pay may result in domain deletion.

6. Service level (SLA)

We target 99.9% monthly uptime. If we fall below this for a calendar month (excluding scheduled maintenance announced 48 hours in advance), you may request a service credit equal to 10% of that month's invoice for each full hour of downtime, up to a cap of 50%. Credits are your sole remedy for downtime.

7. Your content

You retain all rights to content you upload or create on the Services. You grant NetWise a worldwide, royalty-free license to host, reproduce, and transmit that content solely as needed to operate the Services on your behalf.

8. Intellectual property

The NetWise platform, dashboard, brand, and documentation are owned by NetWise and protected by copyright and trademark law. You may not copy, modify, or create derivative works of our software except as expressly permitted.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent permitted.

10. Limitation of liability

To the maximum extent permitted by law, NetWise's total liability for any claim arising out of the Services is limited to the amount you paid us in the 12 months preceding the claim. NetWise is not liable for indirect, incidental, consequential, or punitive damages.

11. Termination

You may cancel at any time from your dashboard. We may suspend or terminate your account for material breach with notice, or immediately for security or legal reasons. On termination, your data will be available for export for 30 days, then permanently deleted.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Laramie County, Wyoming.

13. Changes

We may revise these Terms. We'll email account holders at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
